Ken Weinstein fashions himself a community leader, a philanthropist, and someone who in his own words claims,

” My business plan was 50 percent financial gain and 50 percent community improvement “  

But, is that really the case? Is Kenny’s cause really a community cause, or is it a strategic businessmaneuver by a predator who leverages community support in order to further his own financial agenda?
One needs to look no further than the Rita’s Water Ice derailment perpetrated by Ken Weinstein. 

“New Waldorf School Campus comes to Germantown.”

Another test of community faith would have been the inclusion of the long time neighborhood located, minority owned, small business
Eley Electrical Contracting for the New Waldorf School Project. But Ken Weinstein did not include Eley Electric in his “Community Development”.
Figuring that his business model is  ”50% community improvement” one would imagine that Eley Electric would have been a no-brainer for Ken Weinstein.
But that wasn’t the case.

“It’s our goal to make an impact in our community, one property at a time,”
said Weinstein,

It seems that Ken Weinstein’s community involvement starts in the community’s pocket, and ends at his.

Ken Weinstein likes to fashion himself as a pillar of the community. Ken would have you believe that everything he does is for the betterment of the community and the financial gains of his “community involvement” are secondary. But, is that really the case? Along with the Rita’s Water Ice debacle, the refusal to include Eley Electric for his Waldorf School Project may have you questioning Ken Weinstein’s Community Activism.

Who is Eley Electric?

Eley Electrical Contracting is a Community Small Business, Minority Owned & Operated Firm from right here in the heart of Germantown. Eley Electric even rents their office space from Philly Office Retail, a Ken Weinstein Company!! A matter of fact, Eley Electric’s office is just blocks from the New Waldorf School, Ken Weinstein’s Flagship Project.

Eley Electric is a community contractor who best represents the neighborhood employing a diverse city workforce. Eley Electric is the perfect example of what a Community business should be. Eley Electric provides good paying jobs to I.B.E.W. Members from the community whose Area Wages & Benefits support the community.

– A fact that Ken Weinstein would admire – or one would think anyway

But Ken Weinstein did not include Eley Electric on the Project. Ken Weinstein decided to include another Electrical Contractor for his project, a company who is not from the community, a company who does not represent the community, and a company who does not support Area Wages & Benefits.

Ken Weinstein Kills Rita’s Water Ice and Jobs for Chestnut Hill???

Back in the Winter of 2012, John Thain a Chestnut Hill Resident and Entrepreneur were in the process of bringing a Rita’s Water Ice to a vacant property in the Chestnut Hill Plaza.

But not so fast, Ken Weinstein had other idea’s…

Ken Weinstein challenged the planned Rita’s Water Ice under the context of 1990 “restrictive covenant” banning fast food restaurants from the site. Despite the support of the Community Association, Weinstein threatened Legal Action if the Rita’s went forward.

“The crux of the legal argument is the interpretation of a restrictive covenant for the property.  The covenant, written in 1990, prohibits certain business on the property such as pet stores, butcher shops, laboratories, auto service centers and “fast food” chains.  The terms and conditions of the agreement mention fast food restaurants McDonald’s, Taco Bell and Domino’s Pizza “by way of example, but without limitation.”  A proviso also states that “no present lease will be amended to permit such use.”  A takeout food or beverage business is also prohibited unless in “conjunction with a bona fide restaurant.”

The covenant states that any property owner within 750 feet of Chestnut Hill Plaza has the right to seek its enforcement.  The Trolley Car Diner is within those boundaries.  ”Rita’s is clearly a fast food chain,” Weinstein emphasized. “The Chestnut Hill Community Association can approve this, but they’re just looking the other way.”

Ken Weinstein Claims he Wants Competition.

I guess Ken Weinstein isn’t really interested in competition after all. Is it a coincidence that Mr. Weinstein owns & operates a Water Ice & Ice Cream Shop right next door to his Trolley Car Diner, just several hundred feet away from the proposed Rita’s Water Ice???

As a self-described community leader, Ken Weinstein takes a great deal of pride in employing community people in his community based businesses.
That’s why Ken Weinstein’s opposition to Paid Sick Leave was quite the eye-opener.
What was even more bizarre, is Ken’s apparent lack of respect for his employee’s dedication and hard work.

Dear Council Member,

I am writing to urge you to oppose Bill 080474, the Sick Leave Bill. If enacted, this legislation would have detrimental effects on Philadelphia restaurants, other small businesses and their employees.

On the surface, this legislation sounds great – give employees seven days of paid sick leave that they can use when they really need them. Unfortunately, nothing could be farther from the truth!(What’s further from the truth Ken, that people get sick, or that they don’t actually need days off???)

Firstly, to make up for the cost of these guaranteed sick days, restaurant owners will have to decrease pay for hourly workers or expect more hours out of salaried employees. I know my employees would rather be paid more rather than have paid sick days that more responsible employees will never use.
(Responsible Employee’s Don’t Get Sick??? Are you saying that your Employee’s aren’t responsible???)

Secondly, my General Manager reports to me that 50% of all employee health related call outs are because the employee has stayed out too late the previous night partying.
(Now, you’re accusing your employee’s of being drunks. Do they actually call the next day and say that “I’m too hung over to work today????)

I am not passing judgment on these employees. What they do on their own time is up to them. I am simply suggesting that less responsible employees will use up all seven of the sick days every year, while the other more responsible employees will have to pick up their shifts and cover for them, while experiencing pay decreases to cover the cost.
(Again, responsible employee’s don’t get sick, and if they do, they then become irresponsible employees?? This train-of-thought is quite confusing. Sick = irresponsible, Not Sick = Responsible. Plus, 50% of Sick Employee’s are really Drunks according to Ken…..)

Drunks at Work

I am not your usual small business owner that opposes all legislation that will hurt our bottom line. I have strongly supported minimum wage increases, no smoking in restaurants and guaranteed health care coverage. This issue is different. It will help a small group of employees who work for unreasonable small business owners that don’t provide sick leave when necessary

While hurting a majority of the employees that don’t work for one of these unreasonable bosses.

Instead of forcing paid sick leave, why not enact legislation that forces business owners to provide unpaid sick leave when an employee really needs it? No one should be fired because they need time off for health reasons just as no one should be rewarded for staying out too late and drinking heavily the night before they are expected to work.
(According to Ken, Paid Sick Leave rewards employees for being drunks, which by Ken’s account makes up 50% of his staff. It seems his whole argument against paid sick leave is that too many bosses are unreasonable and employ Drunks. How Endearing! )

Proponents of this legislation do not understand the nature of the restaurant business. I gladly supply five paid sick days per year to my real estate staff, but none of them have ever used all five days. An across the board requirement does not make sense. I hope you will join me in opposing Bill 080474 before damage is done to our industry.

He insults the community by calling them Drunks, then insinuates that paid sick leave will damage the industry, even though responsible employees don’t get sick. Oh, except the irresponsible employees who do happen to get sick, even though 50% are really just alcoholics!!!
